The 1982 Constitution established the foundation for the legitimacy and constitutionality of China’s reform and opening up. It fostered social consensus grounded in the Constitution and shaped the nation’s image with regards to human rights, the rule of law, and a market economy. Set against the specific historical backdrop and context of the 1982 Constitution’s inception, this lecture delves into its basic principles. These principles include the Chinese Communist Party’s role, China’s constitutional structure, popular sovereignty, human rights protection, the rule of law, power checks and balances, and a unitary system. The lecture will examine these principles from historical, textual, interpretive, and societal change perspectives. Additionally, it will address both academic and practical propositions on upholding the Constitution’s authority and effectively implementing its basic principles.
