Abstract:
The practice of law needs to seek the balance between rights and power, that is, the reasonable distribution ratio of rights and power within the “faquan” structure. It is necessary for any society or country to constantly explore the “current” optimal power/right rate and adjust it in due course. The old adages, “things will develop in the opposite direction when they become extreme” and “beyond is as wrong as falling short”, are helpful in understanding the proper proportion of power and rights in “faquan”. The interpretation and application of the distribution curve of “faquan” must always be associated with rights, power, and the content of interests and property behind them. This lecture will discuss some hypotheses in the general theoretical research of law and initially verify the ideas.

Speaker:
Zhiwei Tong, Distinguished Professor at Guangdong University of Finance and Economics, successively served as Associate Professor at East China University of Political Science and Law, Shanghai Jiaotong University, Zhongnan University of Economics and Law, and Wuhan University. Tong devoted himself to legal theory and constitutional law. His main academic achievement was to put forward and systematically explain the general theory of practical jurisprudence centered on the theory of “faquanism”, which has been used to explain various legal phenomena and promote the limitation of power and protection of rights in contemporary Chinese legal practice.

Albert Chen, Cheng Chan Lan Yue Professor and Chair of Constitutional Law at The University of Hong Kong.
